Introduction
The Nonpublic Postsecondary Education Commission (NPEC/the Commission) was established by the
passage of the Nonpublic Postsecondary Educational Institutions Act of 1990 by the Georgia General
Assembly. The agency staff began operations on April 10, 1991, and the first Board of Commissioners were
appointed by the Governor in 1992. Prior to the creation of NPEC, the Georgia Department of Education
was responsible for regulating non-degree granting institutions (under the Proprietary School Act) and
degree granting institutions (under the Postsecondary Educational Authorization Act). The Nonpublic
Postsecondary Educational Institutions Act of 1990 repealed these earlier statutes and consolidated
regulatory authority within the Commission.
As of 2015, NPEC is the agency that houses the Georgia Authorization Reciprocity Agreement (GA-
SARA). This program is part of a national interstate compact that allows public and private colleges and
universities the ability to offer online programming to students across the country without incurring
additional authorization fees in other states.
Though the agency has transitioned to permanent remote work, the NPEC administrative office is in
Tucker in the Georgia Student Finance Commission building. The Nonpublic Postsecondary Education
Commission is attached to the Georgia Student Finance Commission for administrative purposes only.

Board of Commissioners
Pursuant to O.C.G.A.ยง 20-3-250.4, the Board of Commissioners is comprised of eleven (11) members appointed by the
Governor and confirmed by the Senate. The members are appointed for three-year terms of office and may serve two terms
consecutively. The 1990 Act specifies the Commission must include a member appointed to represent each of the following:
a degree-granting institution, a nondegree-granting institution, and an exempt institution. The Commission is required to meet
at least quarterly or at the call of the chair. During Fiscal Year 2022, the Commission met five (5) times.
Toby R. Hinton, Chair, Degree-Granting Institution Representative
Hinton is the vice president of financial services at Brenau University. He is a member of the National
Association of College and University Business Officers and the American Institute of Certified Public
Accountants. Hinton earned a bachelorโ€™s degree in Accounting and Business Administration from Presbyterian
College. He is licensed as a certified public accountant. Hinton and his wife, Suzanne, have two children and live
in Suwanee.
Norma Nunez-Cortes, Vice Chair, At-Large Post #6
Nunez-Cortes is the Title I Federal Program Director for the Appling County Board of Education. She is a
former president and current vice chair of the Baxley-Appling County Chamber of Commerce. Nunez-Cortes
is a member of the Heart of Georgia Altamaha Regional Commission, the Appling County Hospital Authority
and the Appling County Family Connection Collaborative. She is also a member of the Lions Club
International, Kiwanis International, the Appling County Board of Health and Telamon HSEAC. Nunez-Cortes
earned a bachelorโ€™s degree in Criminal Justice and a masterโ€™s degree in School Counseling from Georgia
Southern University. She also earned a specialist degree in Educational Administration and Supervision from
Lincoln Memorial University. Nunez-Cortes is a graduate of the Georgia Academy for Economic
Development. She and her husband, Juan, have two children and live in Baxley.
Amanda B. Shailendra, Secretary, At-Large Post #4
Shailendra is the local partner manager for Google Fiber in Atlanta. She previously worked in economic
development for the City of Atlanta and the State of Georgia, where she supported projects for Mercedes-
Benz, KIA Motors, athenahealth and AT&T Mobility. Shailendra sits on the board of directors for the Georgia
Department of Economic Development and Dadโ€™s Garage Theatre Company. She is also a member of the
honorary board for the Atlanta Ballet. Shailendra earned a bachelorโ€™s degree from Wake Forest University and
a masterโ€™s degree from Georgia Tech. She and her husband, Paul, have two children and reside in Atlanta.
Dr. Drew Van Horn, Exempt Institution Representative
Van Horn is president of Young Harris College. He has over 30 years of experience in higher education, including
nine years as president of Brevard College in North Carolina, a private, residential liberal arts college affiliated with
the United Methodist Church. Prior to his tenure at YHC, Van Horn served as interim vice president of university
advancement at Iowa Wesleyan University in Mt. Pleasant, Iowa. He also served as vice president of institutional
advancement at Lenior-Rhyne University in Hickory, North Carolina. Van Horn currently serves on the Board of the
Georgia Independent College Association and the Peach Belt Athletic Conference. He is a two-time Academic All-
American in basketball and is a member of the Elon University Athletic Hall of Fame. Van Horn earned a Bachelor of
Arts at Elon College, an M.Ed. from Campbell University in Buies Creek, North Carolina, and a Ph.D. in Higher
Education Leadership from the University of South Carolina. He and his wife, Camille, have two grown children.
Ryan Blythe, Certificate-Granting Institution Representative
Blythe is the founder of the Georgia Trade School. He was previously a member of the Go Build Georgia
Advisory Council and sat on the boards of the Kennesaw Business Association and the Construction Education
Foundation of Georgia. Blythe is a graduate of Oglethorpe University. He has one child and lives in Smyrna.

Pranay Udutha, At-Large Post #1
Udutha is QuantumScape's Director of Strategic Initiatives / Corporate Development. Previously, he invested in
early-stage startups driving sustainability across every sector of our economy at ARPA-E, the federal government's
venture capital agency. He led the agencyโ€™s corporate development team and was operationally engaged with a
broad range of startups, from agtech to aerospace. He was previously a senior advisor in the White House, where
he developed strategic partnerships with private sector firms and with other nations on various economic
development issues. On Capitol Hill, Pranay served on the Senate Finance Committee for 2017โ€™s landmark tax
reform negotiations, and advised members of Congress on various issues, from economics to higher education
policy.
Doug Roper, At-Large Post #2
Roper is the Mayor of Vidalia and the Branch Manager at Vidalia Federal Savings Bank. An active member of his
community, Roper has served on the Greater Vidalia Chamber of Commerce Board of Directors, served as a
mentor with Toombs County Family Connections and past chair of the Fellowship of Christian Athletes. He
served nine years as a member of the Vidalia City Board of Education and past President of Georgia School Boards
Association. Roper holds a bachelorโ€™s degree in Speech and Communications from Clemson University. He and
his wife, Marly, have two sons.
P.K. Martin, At-Large Post #3
Martin is a former state senator from Georgiaโ€™s 9th District. During his time in the General Assembly, Martin
was the chairman of the Education and Youth Committee and served as an Administration Floor Leader from
2017-2021. In 2000, he graduated from Georgia Tech with a bachelorโ€™s degree in International Affairs and went
on to join Hood Insurance Agency, where he is now president. He and his wife, Amanda, have two children and are
active members of Holy Cross Cathedral in Loganville.
Holly C. Kirbo, At-Large Post #5
Kirbo is an attorney. She previously worked as associate general counsel for Flowers Foods. Kirbo is a
published author and a member of the State Bar of Georgia. She is also a member of the committee overseeing her
local YMCA gymnastics team. Kirbo earned a bachelorโ€™s degree in Business Administration and a law
degree from the University of Georgia. She and her husband, Cliff, have three children and reside in Moultrie.
Jim Squire, At-Large Post #7
Jim Squire, Certified Franchise Executive, serves as president and CEO of Franchise Marketing Advisors, LLC, a
broad-based franchise development consulting practice. Prior to FMA Squire was a senior executive with such well-
known franchise brands as Firestorm, HoneyBaked Ham, Great American Cookies, Arbyโ€™s, Dayโ€™s Inns, and Howard
Johnson. Passionate about franchising as the โ€œgreat American dreamโ€, Squire is a member of the Board of Trustees
of the International Franchise Association Foundation and recipient of the Foundationโ€™s highest honor, the William
Rosenberg Leadership Award. He is the founding chairman of IFAโ€™s Institute of Certified Franchise Executives and is
a former member of the IFA Board of Directors. On the local level, he serves as chairman emeritus of the
Southeast Franchise Forum and chairman emeritus of the Georgia Restaurant Association.
Kate Patterson, At-Large Post #8
Patterson is the first appointed Director of the newly created Watkinsville Downtown Development Authority.
Additionally, she is on the Board of Bethel Haven, a non-profit Christian Counseling Agency in the Athens area,
volunteers with the Presbyterian Homes of Georgia, and serves in her Church. Her experience in non-profit
leadership and real and her passion to serve her community support her interest in seeing her community of
Watkinsville thrive. Patterson is a former Preschool Director. She is a 2011 graduate of Leadership Georgia and
served as a Program Chair for the organization in 2015. She is passionate about people and loves to serve.

Tuition Guaranty Trust Fund Board of Trustees
Pursuant to O.C.G.A. ยง 20-3-250.27(b)(2), the Board of Trustees, who administers the Tuition Guaranty Trust Fund, is
comprised of five (5) members of the commission designated by majority vote of the commission, where at least two
members, by June 30, 2020, shall represent postsecondary educational institutions. The five members of the commission
who are selected serve one-year terms. The commission appoints one of the members as chairman of the Board of
Trustees. The executive director serves as executive director and secretary of the Board of Trustees. Three members of
the board constitutes a quorum and meets quarterly or at the call of the chairman. During Fiscal Year 2022, the Board of
Trustees met four (4) times, prior to each of the Quarterly Commission meetings.

Comments from the Executive Director
The Nonpublic Postsecondary Education Commission (NPEC) provides a service to Georgiaโ€™s
citizens by authorizing and regulating the operations of for-profit and not-for-profit private postsecondary
institutions. Additionally, it is responsible for oversight of out-of-state public and private institutions that
choose to operate in Georgia.
NPEC is leading the way in modernizing higher education regulation. During the 2022 legislative
session, the agency passed major overhauls to the agency code, expanding school exemptions to help
focus agency efforts to better protect Georgia students and removing bureaucratic burdens on schools,
such as agent permits and required surety bonds. Additional protections were added to allow the agency
to be better responsive to students when institutions close precipitously. NPEC has embraced Governor
Kempโ€™s goal to continue to make Georgia the number one state in which to conduct business and raise a
family.
The agency moved all agency staff to a permanent remote work status in FY22โ€”the first and
only agency to do so in the state. These changes will result in long-term budget savings as the agency
reduced its real estate footprint from 2,000 sq. ft. to 376 sq. ft. This is being accomplished while still
maintaining the highest standards of customer service and productivity among staff.
Additionally, in Fiscal Year 2022, NPEC continued to focus on quality improvement initiatives
by finding new ways to improve agency efficiency through restructuring the agency to better meet the
needs of initial applicants. The agency continues to fund the position of a Contract File Clerk to continue
the full-time project of digitizing all hard-copy student records. This effort will result in long-term
savings to Georgia taxpayers and greater efficiency in fulfilling student transcript requests.

Organization
This agency administers the Nonpublic Postsecondary Educational Institutions Act of 1990 by providing
ongoing assessment and evaluation of private postsecondary institutions operating in the state. Oversight is
achieved through review and processing of institutional applications and inspection of in-state physical
facilities, investigation of student complaints, and facilitation of institutional closures and the resulting
surrendered student records. Additionally, staff regularly propose new or revised policies and procedures
in the aim of enhancing Commission operation and effectiveness, reducing regulatory burdens on institutions
while balancing student interests, and consumer advocacy.

The agencyโ€™s mission is to ensure that each authorized nonpublic postsecondary educational institution in
Georgia is satisfying its commitments to hardworking Georgians through sound academics and financial
stability.
Vision
The vision of the agency is to promote excellence, efficiency, and systematic improvement in the regulation
of nonpublic postsecondary educational institutions to ensure quality education for improving the workforce
in Georgia and the lives of Georgiaโ€™s citizens.
Core Values
The agency provides the critical consumer protection functions of assuring prospective and enrolled
students that the institutions regulated meet minimum standards and assuring prospective employers that
graduates have acquired appropriate job skills while balancing the regulatory burdens that Georgia
institutions face to provide educational programming to students.

Appropriations and Revenue Collections
NPEC is a revenue generating agency primarily resulting from fee collections required as part of institutional
applications for annual authorization, which are based on tuition received by an institution during its most
recently completed fiscal year or, in the case of initial authorizations, projections for the first year of
authorization. In addition, other fees are based on specific services performed by NPEC such as approval
of a change of ownership, evaluation of proposed new programs and updates to administrative records.
Fees are also collected for transcript requests, as part of applications for exemption, as well as for financial
viability assessments. Revenue collections for Fiscal Year 2022 were $1,144,524. Additionally, NPEC collects
funds from select institutions for the Tuition Guaranty Trust Fund that are maintained by the agency for
studentโ€™s adversely affected by precipitous closures. These collections are detailed in another area of this
report (starting on p. 31).
NPECโ€™s state appropriation for its Fiscal Year 2022 annual operating budget was $949,495. No federal funds
are received.

Activities
Regulatory Compliance
O.C.G.A. ยง 20-3-250.8 requires each nonpublic postsecondary educational institution desiring to operate
or conduct postsecondary activities in Georgia to file an application for authorization. To ensure application
of the law governing this agency and its associated institutions, regulatory compliance is central to NPEC
operations. This is achieved through the authorization process, which includes application review and
critique, curriculum evaluation, complaint mediation, and, for in-state institutions, annual campus visits.
Curriculum evaluation occurs when an institution proposes a new or modified program. This process may
require the formation of a committee, made up of an expert or team of experts who specialize in the field
of instruction of the proposed program, who will offer a recommendation to NPEC as to its quality. All
compliance activities are reviewed by multiple NPEC professional staff persons for accuracy, consistency,
and adequacy and then are recorded electronically in a customized agency database. This permits easy and
secure access to all relevant institutional documentation associated with NPEC oversight. Authorization
differs from accreditation in that accreditation is a voluntary process in which educational institutions of
higher learning are evaluated by a peer review board whose members include faculty from various
accredited colleges and universities. Whereas NPEC is the stateโ€™s arm in regulating postsecondary
education, recognized accreditors are granted authority by the United States Department of Education to
accredit institutions, which will in turn qualify to receive federal financial aid.
Additionally, certain institutions are exempted from seeking authorization; alternatively, those institutions
seek a Notice of Exemption, the details about which are expanded upon in the section titled Postsecondary
Institutions Exempted from Authorization.
Academic Record Keeping
NPEC requires that authorized institutions maintain student academic records in a prescribed format. This
not only allows for consistent student access but also supports the transfer of student records to the agency
with a minimum of difficulty in the event the institution closes. O.C.G.A. ยง 20-3-250.17 mandates such
transfer to the state/NPEC, and institutions are required to provide a signed Record Agreement annually
as part of the Renewal of Authorization Application. In addition to stipulations associated with closure, this
document also provides requirements for ongoing record maintenance while the institution is in operation.
With regards to academic records of closed institutions previously authorized by NPEC, the Commission
is responsible for fielding transcript requests from students and/or approved representatives. While
inquiries are made through an electronic form available on the NPEC website, as of June 30, 2022, 1,300
boxes of student records from closed institutions are stored at the State Records Center. In FY22, due to
on-going student digitization process by a full-time contract File Clerk, the number of boxes stored at the
State Records Center has been reduced by 492 boxes since June 30, 2021 and 1,670 boxes since June 30,
2019. One NPEC staff member is assigned the responsibility of processing transcript requests, which
typically number between 700-800 annually.

Institutional Closures
In Fiscal Year 2022, twenty-one (21) NPEC authorized institutions closed. During closings, NPEC staff
typically work with the institutionโ€™s representatives, students, and other institutions to provide students
with the opportunity to complete their programs of study either at the closing institution or at another
institution. Student academic records were sought upon receipt of notification of each closure. To
provide student access, records were then either transferred to the State Records Center or to other
active campuses of the closed institution. When an institution or campus ceases operations, it is
considered to be an institutional closure and pursuant to O.C.G.A. ยง 20-3-250.17, institutions are required
to provide academic records to NPEC.
Additionally, seven (7) institutions became recognized in Georgia as SARA participants; therefore, they no
longer needed to maintain authorization, and fourteen (14) institutions transitioned from authorization to
exemption from authorization due to the expansion of eligibility for exemption of institutions located on
military bases in accordance with O.C.G.A. 20-3-250.3(a)(8) effective July 1, 2021.
Student Complaints
To provide consumer protection, O.C.G.A. ยงยง 20-3-250.5(c)(5) & 20-3-250.3(a)(7), (10), (11), (14) provides
NPEC with the lawful responsibility to investigate complaints filed against institutions. NPEC requires that
complaint policies of authorized institutions include a studentโ€™s right to appeal an institutionโ€™s final
determination with NPEC. Complaints are submitted electronically on the NPEC website, and a full
investigation is completed by the NPEC staff person responsible for the compliance review of the institution.
This process involves consultation with appropriate institution officials upon receipt of a complaint and
visitation to institutions, as needed. NPEC regards the prompt resolution of complaints from students as a
high priority of the agency. In addition to formal complaints, NPEC responds to all inquiries and concerns
made by students regarding the institution at which they are enrolled. In Fiscal Year 2022, NPEC investigated
forty-six (46) student complaints.

SARA State Portal Entity
The State of Georgia became a member of the National Council for State Authorization Reciprocity
Agreements (NC-SARA) in October 2015. As the state coordinating โ€œportalโ€ agency, NPEC assures that
institutions which are SARA-approved in their own states follow NC-SARA policy in providing on-line
programming to residents of Georgia. NPEC reviews applications from Georgia institutions wanting to
become SARA-approved by the state so that those institutions may offer online programming to residents
of other states. NPEC also serves as the agent for complaints filed relative to Georgia-SARA approved
institutions and facilitates the resolution of complaints filed by Georgia residents relative to out-of-state
institutions.
During Fiscal Year 2022, a total of eighty-seven (87) Georgia institutions were SARA-approved through
NPEC action and became institutional members of NC-SARA. Of these, twenty-six (26) were University
System of Georgia institutions, twenty-two (22) were Technical College System of Georgia institutions,
and thirty-nine (39) were Georgia nonpublic degree granting accredited institutions.
The most recent data available (ending FY21) shows that 87,332 students located in Georgia took online
courses at an out-of-state institution participating in SARA, and 55,919 out-of-state students took online
courses at a Georgia institution participating in SARA.
Participation in SARA is of great benefit to the state of Georgia. In 2018, the National Center for Higher
Education Management Systems conducted a return-on-investment study that estimated that colleges and
universities in Georgia saved $7.7 million for initial authorization and annually saves $2.2 million on renewal
applications. By contrast, in FY22, the eighty-seven (87) Georgia institutions participating in GA-SARA paid
a combined $417,500 in fees to participateโ€”$145,500 to GA-SARA and $272,000 to NC-SARA.

Postsecondary Institutions Exempted from Authorization
Pursuant to O.C.G.A. ยง 20-3-250.3, certain postsecondary educational institutions are not subject to the
Nonpublic Postsecondary Educational Institutions Act of 1990; therefore, they are excluded from NPEC
authorization (i.e., โ€œexemptโ€).
Under O.C.G.A. ยง 20-3-250.3(a)(4), all state operated higher education institutions are exempt from NPEC
authorization as are the thirty-six (36) independent private colleges and universities [O.C.G.A. ยง 20-3-
250.3(a)(10), (11), (13) and (14)].
Under O.C.G.A. ยง 20-3-250.3(a)(4), institutions that are regulated by other state agencies are exempt from
authorization, such as those regulated by licensing boards under the Georgia Secretary of State or Board of
Nursing. Some examples include cosmetology, select nursing programs, barbering, truck driving, and real
estate institutions.
Under O.C.G.A. ยง 20-3-250.3(a)(6), seventy-six (76) religious institutions are exempt from NPEC
authorization. Annually, each religious institution must demonstrate to NPEC that the institution grants
only religious degrees and/or certificates; does not receive federal or state funds; and does not accept
students using federal or state loans to attend.
Additionally, as set forth by O.C.G.A. ยง 20-3-250.3(a), NPEC exempts numerous โ€œotherโ€ institutions that
meet the exemption criteria that include education solely avocational or recreational in nature, flight training
schools approved by the Federal Aviation Administration, test and tax preparation, institutions on military
installments solely for the education of military personnel and their dependents, and education sponsored
by a trade, business, or fraternal organization solely for that organizationโ€™s membership.

Pursuant to O.C.G.A. ยง 20-3-250.8(c), NPEC is responsible for in-state โ€œon-site inspections of the physical facility in which
the institution will be operating.โ€. In accordance with O.C.G.A. ยง 20-3-250.8(g), such on-site inspections are also required
for Renewal of Authorization applications. Additionally, NPEC completes other visits as deemed necessary by staff for
purposes of ensuring compliance with the Minimum Standards. In FY22, 268 site visits were conducted. As a note, legislative
changes effective July 1, 2021 allowed NPEC to conduct virtual site visits for qualifying institutions, which are reflected

ADVERSE ACTIONS
NPEC is responsible for ensuring compliance with applicable state laws and associated policies and procedures.
As such, adverse actions are the official activities completed by the agency when an institution fails to comply
with key directives, such as requiring Authorization, taking down programmatic advertisements, and
surrendering student records.
A common adverse action is the notification to an institution that it is operating without Authorization. This is
first communicated with a cease-and-desist warning email and, if needed, a follow up formal cease-and-desist
email. Information detailing the Authorization process as well as agency contacts are also provided. In FY22,
eight (8) such cease and desist emails were sent.
Should the noncomplying institution fail to adequately respond to the cease-and-desist email, a cease-and-desist
letter is sent certified to the address of record as well as to the email of record. Formal Closure, Notification of
Noncompliance, and Student Record Demand Letters, either directing the institution to cease operation until
Authorization is obtained or to surrender student records in accordance with O.C.G.A. ยง 20-3-250.17,
respectively, are also sent by NPEC. These are sent certified to the address of record as well as the email of
record. In FY22, seven (7) cease and desist letters and one (1) record demand letter were sent.
If it becomes clear the agency is not having success communicating with a noncomplying institution, NPEC will
request action from the Office of the Attorney General of Georgia. In FY22, four (4) such request was made.
Additionally, one (1) complaint was filed by the Attorney General on behalf of NPEC against a
noncomplying institution.
GNPEC also publishes Consumer Alerts on its website. In FY22, four (4) such alerts were posted.

LEGISLATIVE SUMMARY
GNPEC experienced substantial legislative changes that were presented and passed during the 2022
Session. This legislative proposal included three main areas. First, expanding exemptions by reducing
GNPEC oversight to schools offering degrees and certificates orโ€ฏprogramming affecting public safety or
welfare, such as medical-related instruction even if not leading to a certificate or degree. Second, the
legislative changes included removing agent permit requirements which reduced regulations and application
overload but maintains the institutionโ€™s responsibilities of its recruiters and representatives. Lastly, the
changes reduced bonding requirements from all authorized institutions to only institutions that have been
found to be experiencing financial hardships while expanding the powers and amounts of the Tuition
Guaranty Trust Fund (TGTF). This reduced regulations on institutions and allows the state to increase the
amount of funds into TGTF, giving the opportunity to self-insure in the event of precipitous closures in
addition to allowing the agency to be more responsive to student needs (bond surrenders may take several
years and litigation to procure).โ€ฏThe changes were signed by Governor Kemp and took effect on July 1,
2022.

FINANCIAL VIABILITY ASSESSMENTS
O.C.G.A. ยงยง 20-3-250.6(a)(1)(H) & 20-3-250.6(c) establishes that authorized and exempt institutions must
meet the standards to be financially sound and capable of fulfilling their commitments to students. Beginning
in April 2015, NPEC implemented a rigorous financial viability assessment (FVA) of authorized institutions
to prioritize institutional fiscal stability as part of the overall evaluation required for authorization and to
protect the TGTF. Proactive review and communication with the institutions has assisted NPEC to enhance
its planning of potential teach-outs and estimations of student reimbursements, both of which are often
required in the case of institutional closures.
The financial viability assessment at NPEC is achieved through a collaborative review of financial
documentation submitted by authorized institutions, completed by both NPEC professional staff and an
external auditor. For all authorized and โ€œaudit onlyโ€ exempt institutions, financial viability assessments are
completed annually. In both NC-SARA and GA-SARA applications, a Department of Education Financial
Responsibility Composite Score is a required component. For those GA-SARA applicants/renewing
institutions that do not participate in Title IV (Federal Financial Aid) or whose Composite Scores are
between 1.00 and 1.5, NPEC conducts a financial viability assessment. In Fiscal Year 2022, three hundred
and forty-seven (347) authorized institutions, thirty-six (36) audit and bond only exempt institutions, and
one (1) GA-SARA institution was assessed. The possible outcomes are as follows:
Low Financial Monitoring โ€“ The institution is found to be without significant findings to doubt concern of
its financial viability. It has satisfied indicators of sound financial health. Examples include the provision of
financial information demonstrating current assets that exceed current liabilities and reflect a positive net
working capital, profit, or surplus from the prior fiscal year. Additionally, if applicable, the institution indicates
a low risk of stocks to assets and meets United States Department of Education (USDOE) requirements.
Moderate Financial Monitoring โ€“ The institutionโ€™s financial stability is found to be in question. There are
some findings that have raised concerns over the financial viability of the institution, but they are not
significant. An institution with some findings may be required to provide specified documentation (e.g., Audit)
or show improvement in its financial position within a set period. The institution may be asked to provide a
Financial Improvement Plan (FIP). If it is required to provide the FIP, the institution will be subject to the
โ€œFinancial Improvement Plan Guidelinesโ€ provided on the GNPEC website.
High Financial Monitoring โ€“ There are significant findings to raise concern over the financial viability of the
institution. If an institution is found to need High Financial Monitoring, its financial position suggests a high risk
for closure. If an institution is found to need High Financial Monitoring, it will be required to provide a financial
improvement plan (FIP). It will be subject to the โ€œFinancial Improvement Plan Guidelinesโ€ provided on the
GNPEC website.
An institution may be required to produce some type of documentation or show proof of a change in its
financial position before full authorization will be given. The timeline for producing the documentation or
making the improvement will be given by the program manager or auditor. The requirements and timeline will
be communicated to the institution by the RS unless a teach-out plan is required. When a teach-out plan is
required, the Deputy Director will send an official notice on GNPEC letterhead. If an institution is required to
provide a โ€œTeach-out Planโ€, the institution must at the same time provide GNPEC with transcripts for all
previously graduated students and provide the transcripts on a quarterly basis.

TUITION GUARANTY TRUST FUND ACTIVITIES
O.C.G.A.ยง20-3-250.27 created the Tuition Guaranty Trust Fund (TGTF), which is designed to provide a
teach-out or refund to students at institutions that close and fail to honor commitments to complete the
studentsโ€™ programs of study. The TGTF serves as an insurance pool of funds available for students of closed
institutions. NPEC adopted a fee structure, based upon one-tenth of one percent of the institutionsโ€™ annual
gross tuition receipts. Beginning in July 1992, authorized institutions began to make annual payments to the
TGTF. In accordance with O.C.G.A. ยงยง 20-3-250.27(e) & 20-3-250.27(h), the following chart reflects the
activities of the TGTF over the past eight years and the financial strength of the fund. Teach-out of Students
is the cost associated with the completion of a course of study at another institution following the closure
of an institution. Refund of Tuition is the amount of reimbursement paid to students should they be unable
or unwilling to complete their programs elsewhere.

ACCOMPLISHMENTS
Accomplishments
โ€ข Implemented move to permanent remote work plan, including downsizing of agency footprint from
2,000 sq. ft. to 376 sq. ft., creating approximately $16,000 in budgetary savings annually.
โ€ข Completed internship program in partnership with Georgia Tech.
โ€ข Created two Senior Regulatory Specialist positions, one of which serves as the Initial Applicant
Coordinator and the other as the Financial Assessment Coordinator.
โ€ข Implemented monthly training sessions for initial applicants to support customer service initiatives and
to improve application processing efficiencies.
โ€ข Implemented quarterly renewal training for institutions seeking reauthorization.
โ€ข Staff continued to efficiently operate with record-high institutional workloads (355 total authorized
institutions).
โ€ข Implemented requirements of institutional compliance with the Secretary of State by requiring
documentation of registration as part of authorization applications.
โ€ข 4 GNPEC staff members presented at the NASASPS Annual conference as subject matter experts
providing best practices and lessons-learned regarding the improvements made to the Initial Application
process.
โ€ข Developed new MOU with Georgia Student Finance Commission (agency to which NPEC is
administratively attached) to ensure adequate provision of needed agency services.
โ€ข Agency legislation signed into law for effect beginning FY23 to reduce regulations, expand consumer
protections allowed under the TGTF, and eliminate the administrative burden of surety bonds as a
standard application requirement.
โ€ข Revised Schedule of Fees, presented to and approved by the Board of Commissioners, to simplify some
administrative processes and incentivize timely applications submissions and site visit scheduling.
โ€ข Strategic Plan goals met include decreased renewal application review period by 20%, decreased
investigation time of complaints by 25%, reduced โ€œContact Usโ€ submissions on the website by 10%, and
decreased transcript turnaround time by 50%.
